Accidents Waiting To Happen

What is to be learned, when an individual who has suffered an accident or injury through no fault of their own fails to claim for there injuries or reports the event to a local authority or even an employer. Are they running the risk of allowing that accident to happen again? We all have an obligation to avoid causing harm to others.

Understanding that the claim process is not only there to provide compensation but also stops similar instances from happening again - lessons learnt provides safer environments for everybody. Failing to act after an accident allows for the probability of a similar accident happening to someone else.

Intellectual Property Law-trade Mark Registration-vita

The recent case of Sunrider Corporation v VITASOY International Holdings Ltd [2007], concerned an opposition to a trade mark registration. According to s.5(2) of the Trade Marks Act 1994:

“A trade mark shall not be registered if… it is similar to an earlier trade mark and is to be registered for goods or services identical with or similar to those for which the earlier trade mark is protected, [and] there exists a likelihood of confusion on the part of the public, which includes the likelihood of association with the earlier trade mark”.

Non-patent literature search is of great importance in the IP domain. Patentability search of any new invention is very crucial and can be achieved by both patent s and non-patent literature search. As far as, my knowledge the patents database is only domain set which is highly organized and easy to access either through free databases or commercial databases. But, the non-patent information such as journals, research publication and disclosures, thesis, etc. are scattered all over the web. There are few databases and vendors which have a good collection of this information and have tried to organize them in easy to access manner. But there are still big whit spaces for further improvements.

Teaching About Copyright In The Classroom

Fact #1- The “Fair Use” part of the US Copyright Law says that in most cases you can allow your students to use copyrighted material such as songs, photos, and other media as long as the finished product is not going to be reproduced and distributed.

Fact #2- In real life (outside the classroom) doing the same thing is illegal and a violation of copyright law punishable by fines and/or jail time.

Raising Some Points On Racial Discrimination In The Workplace

“I am deeply disappointed of my employer. He terminated me from my job recently. I have done nothing wrong. Is it a great deal for him if I belong to a different race? What should I do now? How can I support my family’s needs? Who would dare to rescue me from this terrible situation?” These were some of the questions I heard my friend ask who believed that he has been wrongfully terminated from work. Our conversation prompted me to conduct a study about the law which prohibits employers from firing their employees on the sole basis of their race or color – the Title VII of the Civil Rights Act of 1964.
